Highlights

  • The U.S. Court of Appeals ruled in favor of Bayer-owned Monsanto, rejecting allegations that the company neglected to warn users about the cancer hazards of Roundup.
  • The court emphasized that state labeling laws cannot override federal regulations, noting that the EPA did not mandate a cancer warning on Roundup.
  • This ruling contrasts with decisions from other appellate courts, prompting Bayer to urge the U.S. Supreme Court to resolve the conflicting interpretations.

In a significant legal win for Bayer-owned Monsanto, a federal appeals court reversed a prior verdict that held the company liable for cancer claims linked to its Roundup weed killer.

The U.S. Court of Appeals for the Third Circuit in Philadelphia ruled against Pennsylvania residents David Schaffner, Jr. and Theresa Sue Schaffner, who alleged that Monsanto violated state law by not including a cancer warning label on Roundup. The plaintiffs claimed that exposure to Roundup caused David Schaffner's non-Hodgkin’s lymphoma.

The court cited the Federal Insecticide, Fungicide, and Rodenticide Act (FIFRA), which prohibits states from imposing labeling requirements that differ from federal standards. Since the Environmental Protection Agency (EPA) approved Roundup's label without a cancer warning, the court found no legal violation.

This ruling contradicts decisions from appellate courts in Atlanta and San Francisco regarding similar Roundup litigation.

Bayer Calls on Supreme Court to Resolve Legal Dispute

In a statement to Investopedia, Bayer expressed satisfaction with the ruling and urged the U.S. Supreme Court to "settle this critical legal question." Bayer has consistently maintained that Roundup does not cause cancer.

The announcement boosted Bayer's shares, which surged over 11% during German market trading on Friday.
