The International Trade Commission (ITC) has ruled against Apple, prohibiting the import of certain iPhone and iPad models due to patent infringement claims filed by Samsung. The ITC ordered Apple to cease sales of iPhone 3G, iPhone 3GS, iPhone 4, as well as iPad 3G and iPad 2 3G models through the US carrier AT&T. Newer Apple devices are not affected, as they do not utilize the patented technologies in question.

The ITC emphasized that Apple failed to present compelling evidence to counter Samsung's patent claim number 7,706,348. Apple, on the other hand, argued that Samsung had agreed to license the patent under fair, reasonable, and non-discriminatory (FRAND) terms, aligned with the Open Mobile Alliance’s intellectual property licensing principles designed to prevent industry-wide patent disputes. Despite raising this argument during the appeals process, Apple was unable to convince the ITC.

Looking ahead, the ruling enters a 60-day period during which the White House may decide whether to veto the ban. Should no veto be applied, Apple can still appeal the decision while customs authorities will begin intercepting the affected Apple devices imported via AT&T. Historically, the White House rarely vetoes ITC rulings; however, current US President Barack Obama has expressed intentions to curb 'patent trolling' and reduce the frequency of companies seeking ITC bans on competitors' products, potentially influencing this case.

Apple spokesperson Kristin Huguet told AllThingsD and The Verge that the company plans to appeal the decision: "We are disappointed by the Commission’s reversal of the previous verdict and intend to file an appeal. This ruling does not impact the availability of Apple products in the US. Samsung is pursuing a strategy that courts and regulators worldwide have rejected. They have acknowledged it does not serve consumer interests in Europe and elsewhere, yet in the United States, Samsung continues to attempt to block Apple product sales using patents they have agreed to license on reasonable terms."

Samsung issued a statement to the Korean news agency Yonhap News expressing approval of the verdict: "The ITC decision clarifies that Apple has used Samsung’s patents without authorization. We will do everything possible to protect our intellectual property."
