Uber Hit with €290 Million Fine in the Netherlands Over Data Transfer to the US

The Dutch Data Protection Authority has imposed a record €290 million ($324 million) fine on Uber for transferring European drivers' personal data to the United States without sufficient safeguards, violating GDPR regulations.

Key Insights

  • Uber Technologies has been fined €290 million ($324 million) by the Dutch privacy watchdog for improperly transferring European taxi drivers’ sensitive data to servers in the United States without adequate protection.
  • This penalty marks the largest fine Uber has faced so far in Europe, as the company is currently appealing two other fines issued by the Dutch regulator.
  • Uber has publicly stated its intention to appeal the ruling, describing the decision as "flawed" and "entirely unjustified."

The Dutch Data Protection Authority (DPA) found that Uber violated the European Union’s General Data Protection Regulation (GDPR) by sending and storing sensitive personal information of European drivers on US-based servers, exposing the data to risks due to insufficient safeguards.

The fine originated from complaints filed by 170 French Uber drivers, but the Dutch regulator took action because Uber’s European headquarters is located in the Netherlands.

The DPA highlighted that the data transferred included account information, taxi licenses, location tracking, photos, payment details, identity documents, and in some cases, sensitive criminal and medical records of drivers.

Following the ruling, the regulator confirmed that Uber has ceased the data transfer violation.

Uber’s stock experienced a slight decline of less than 1%, closing at $73.80 shortly after the market opened on Monday. Despite this, shares have gained approximately 20% year-to-date.
